On June 2005 322 prisoners who were part of the 589 reduced sentences were let go. Of those released 111 were re-incarcerated for committing another crime or violating their parole. Few offenses involved violent crimes many that were horrendous. 11 1 sent back to prison, they then let out another 111 people from prison. 33 of them were returned to prison for technical violations such as not reporting a new address, committing a misdemeanor offense or failure to pay administrative fees. But only 2 out of the 111 put back in prison were put and killed on death row, 37 of them though had been re-paroled and had not committed crimes again.

The American Civil Liberties Union considers the death penalty to be unconstitutional under the Eight Amendment to the U.S. Constitution and that its discriminatory application violates the Fourteenth Amendment. ACLU organization finds the death penalty highly unconstitutional. As you can tell by their opinion they feel that it impeaches on a human’s rights when they are born. "If we execute murderers and there is in fact no deterrent effect, we have killed a bunch of murderers. If we fail to execute murderers, and doing so would in fact have deterred other murders, we have allowed the killing of a bunch of innocent victims. I would much rather risk the former. This, to me, is not a tough call."
